TERMS AND CONDITIONS
These terms and conditions, together with any and all other documents referred to herein, set out the terms under which users (“Entrants”) purchase tickets on our Site. Please read these Terms and conditions carefully and ensure that you understand them before purchasing on our Site. You will be required to read and accept these Terms and conditions when you are purchasing a ticket. If you do not agree to comply with and be bound by these Terms, you will not be able to purchase anything on our Site.
1. Definitions and Interpretation
1.1 In these Terms and conditions, unless the context otherwise requires, the following expressions have the following meanings:
“Account” means an account required to access and/or use certain areas of our Site;
“Entrant” means a user who is purchasing a ticket on our Site;
“Content” means any and all text, images, audio, video, scripts, code, software, databases, and any other form of information capable of being stored on a computer that appears on, or forms part of, our Site;
“Competition” means a listing on our Site advertising a Prize;
“Our Site” means this website www.ultimatecarpgiveaways.co.uk;
“Payment Service” means the payment service provided by cashflows;
“” means the Carp Coins accumulated after making purchase;
“Prize” means the item being advertised to win;
“user” means a user of our Site;
“user Content” means any Content added to our Site by a user;
“we/us/our” means Ultimate Carp Giveaways, a limited company registered in England under company number 13179623, whose registered address is Dept 3492A, 43 Owston Road, Carcroft, Doncaster, England, DN6 8DA.
2. Access to and use of our Site
2.1 Access to our Site is free of charge.
2.2 It is your responsibility to make any and all arrangements necessary in order to access our Site.
2.3 You may only make purchases on our Site if you are at least 18 years of age and a full time UK resident.
2.4 Access to our Site is provided “as is” and on an “as available” basis. we may alter, suspend, or discontinue our Site (or any part of it) at any time and without notice. Subject to the remainder of these terms and conditions, we will not be liable to you in any way if our Site (or any part of it) is unavailable at any time and for any period.
3. Purchasing
3.1 In order to purchase a ticket, you must register an account with us, you will be asked to provide an email address, name, address, date of birth, and telephone number which will be used to create your Account. Only one email address will be used per Account, and we recommend that you do not save your Account details in your internet browser. We also recommend the password you choose is strong and secure, containing a combination of letters, numbers and symbols, and is changed regularly.
3.2 Sharing of Accounts is not permitted unless we expressly authorise this in writing. You are required to keep your Account details confidential and must not reveal your username and password to anyone.
3.3 When making a purchase of a ticket for a Competition, select the Competition you wish to enter and select the number of tickets you want to purchase, you will be shown a multiple choice question based on skill, knowledge or judgement. Once you have selected an answer, you can add the ticket/s to your basket. Once all desired competition entries are added to your basket, proceed through the checkout process.
3.4 We will then send confirmation of your entry via email which will include your ticket numbers, however if your answer is incorrect, you will not be eligible to win the prize, but you will still be charged.
3.5 You expressly agree that:
3.5.1 You have read the description and all details within the relevant Competition carefully and that you understand and agree to any and all specific policies that are stated to apply;
3.5.2 You will pay for the tickets purchased in full and on time, via the payment system detailed in clause 7; and
3.5.3 You have provided complete and accurate billing and, where applicable, delivery details to us.
3.6. In order to take advantage of a free postal entry, you must send your email address, name, address, telephone number, competition question and your answer to the trading address above and state clearly which Competition you wish to apply for, this is subject to the following conditions:
3.6.1 Only one entry to each Competition is allowed per Account and all details on the free postal entry MUST correspond to the details on the Account.
3.6.2 You are responsible for the cost of UK postage;
3.6.3 Only one ticket per postal entry envelope and entries must be written in the English language; and
3.6.4 Clause 3.5 applies and any correct answer will be treated as an Entry with the same terms and conditions as a paid ticket. Should the Competition close either due to the Competition reaching the closing date or maximum entries before your postal entry is received, it will not be entered into the Prize Draw.
3.6.5 Should this clause not be complied with your free postal entry will not be processed.
3.7 We do not accept responsibility for any entries that are not successfully processed, whether that is due to entries being lost or delayed, incorrectly completed or due to events outside of our control.
4. Competitions Periods and Entry
4.1 Each Competition will run for a specified period and will close at the time stated which will be GMT time, or until all the specified tickets have been sold, however they shall be subject to a final cut off date which shall be no later than 12 weeks after the Competition is advertised on our Site. We reserve the right to change the Competition close date at any time.
4.2 It Is the Entrant’s sole responsibility to check the details entered at the time of Purchase.
4.3 If the timescale of the Competition lapses and ticket sales have not all been purchased, we have discretion as to whether to draw the Competition, lengthen the time period or offer an alternative cash Prize.
4.4 Any directors, shareholders or employees and their households of Ultimate Carp Giveaways Ltd are not permitted to enter any Competitions on the Site.
5. Winner Selection
5.1 The Winner is randomly selected using a third-party random selector tool unless otherwise agreed, and will take place within one week of the Competition closure.
5.2 The Winners will be the first entry drawn at random from all valid entries. Your full name and ticket number shall be shown on the Site and/or on social media platforms.
5.3 Any prize Winner may be required to provide photo ID to us to confirm their age, identity and to prove the initial purchase was made by a card owned by them.
5.4 Our decision is final and no correspondence or discussion will be entered into.
6. The Prize
6.1 All Prizes are subject to availability. We will attempt to contact the Winner using the telephone numbers and email addresses provided at the time of Entry as soon as practicable after the draw date.
6.2 If we are unable to contact the Winner or the Prize has not been claimed within 21 days of the draw date, or the winner is disqualified as a result of contravening any of these Terms and Conditions. The Winner will forfeit the Prize and it will be awarded to another Entry in accordance with Clause 5. For the avoidance of doubt once the Prize has been forfeited the Winner will have no further claims against us.
6.3 The Prize may be subject to the Terms and Conditions of the manufacturer where applicable.
6.4 The Prize shall be as described on the Site within the Competition, in the condition and specification as detailed. No warranties or guarantees shall be given to the Prize unless otherwise agreed, it shall be your responsibility to arrange all taxes, insurances and licences as applicable prior to your collection of such. We shall not accept any liability where this clause is not complied with.
6.5 The Prize when collected or delivered shall be in accordance with any pre-contract information that has been provided by us. If any Prize you have won does not comply and, for example, have faults or are damaged when you receive them which wasn’t stated on the Competition, or if what you have received is incorrect, please contact us within 24 hours to inform us of the fault, damage or error.
7. Payment Service
7.1 All Payments on our Site are processed with cashflows.
7.2 Your use of the payments service will be subject to its own terms and conditions and privacy policy. You will be required to read and accept those terms and conditions and privacy policy before making payments on our Site.
7.3 By using the payments service you acknowledge and agree to us sharing your personal information and/or information about your transactions on our Site with them.
7.4 If we receive notice from the payments service that your use of our Site or the Payment Service is in breach of their terms or of any agreement between you and them, we may take actions including, but not limited to, those necessary to rectify your breach, removing your ability to use the Payment Service to make or accept payments on our Site, and/or the suspension or termination of your Account on our Site.
7.5 cashflows reserves the right to refuse the use of the Payment Service to anyone, for any reason, and at any time.
8. Collection and Delivery
8.1 Details of how the Prize will be delivered, or made available for collection, will be provided once contact has been made with the Prize Winner. Where collection is offered, a collection date must be arranged within 7 days of contact being made with the Prize Winner.
8.2 Collection will be deemed to have taken place when you (or someone identified by you) have taken physical possession of the Prize. The responsibility (or the “risk”) for the Prize remains with us until they have been collected, at which point it will pass to you, and you will own the Prize once collection has taken place.
8.3 We reserve the right to charge for storage if you fail to collect the Prize or any part of them on the agreed date.
8.4 Where paperwork for transfer of ownership is required, including but not limited to vehicle transfer, you must provide all valid details, provide all relevant identification details and allow time for the completion of the paperwork and licences at the time of collection.
8.5 Where we have agreed to deliver the Prize, it shall only be to mainland UK addresses and the postage or delivery costs shall be included within the Prize. You shall provide complete and accurate delivery details to us and must be available on the date of its delivery for acceptance of such.
8.6 Any cash Prize shall be transferred to the Winners nominated bank account. The Winner may be required to provide evidence that they are the sole or joint beneficiary of the bank account. Failure to do so within 21 days will result in disqualification from the competition and the winner forfeiting the prize in accordance with Clause 6.2
9. Carp Coins
9.1 Upon the acceptance of your registration of an Account, you may have the opportunity to accumulate Carp Coins for every purchase.
9.2 You must be logged into your Account at the time of any purchase in order for the Carp Coins to be added.
9.3 Accounts must only be used by the registered user. Any fraudulent use of any Account may result in immediate cancellation of the Account.
9.4 Carp Coins can only be earned, or redeemed as set out in these Terms and Conditions.
9.5 Suspected or actual fraud and/or suspected or actual abuse relating to the accumulation of Carp Coins under the programme may result in forfeiture of accumulated Carp Coins, cancellation of your Account, as well as cancellation of your participation in the loyalty programme.
9.6 When you redeem your Carp Coins, we will proceed to deduct the associated Carp Coins amount from the purchase total in accordance with any offer stipulated at the time.
9.7 If a purchase exceeds the Carp Coins value, the remaining amount must be paid with another payment method.
9.8 Any Carp Coins that have been accumulated have a 36 months expiration period.
9.9 We shall be entitled to end, cancel or suspend the loyalty programme at any time.
9.10 You can choose to close your Account at any time and any Carp Coins accumulated will be lost.
10. Your Rights to Cancel and problems with Prizes
10.1 Please note that by buying a ticket you are consenting to us starting the interactive service immediately and any rights you may have to withdraw from or cancel your purchase (including but not limited to under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013) will be lost because the performance of our services is simultaneous or begins immediately once your purchase is completed.
10.2 We shall endeavour to ensure that Competitions are as described and in accordance with any pre-contract information that was provided to you, should the Prize not conform to such, you may have the right to reject the Prize in exchange for a cash prize for the amount stated within the draw in accordance with this Clause.
10.3 If items do not conform with the requirements outlined in sub-Clause 9.2 and, for example, have faults or are damaged when you receive them, or they are not delivered within a time that is reasonable. You must contact us within 24 hours to notify us of the issue. If after seeing proof we agree that the Prize does not conform and is not as described, our decision is final, and the following remedies will be available to the Winner:
10.3.1 The item shall be repaired or replaced by us in accordance with your consumer rights;
10.3.2 Cash value to repair Prize to the same standard it was advertised as, or compensation for prolonged delivery times; or
10.3.3 Cash Prize if the damage is beyond repair.
11. Our Liability to You
11.1 We will be responsible for any foreseeable loss or damage that you may suffer as a result of our breach of these terms and conditions or as a result of our negligence.
11.2 Subject to sub-Clause 11.2, to the fullest extent permissible by law, we will not be liable to you for any loss of profit, loss of business, interruption to business, or for any loss of business opportunity.
11.3 Nothing in these terms and conditions seeks to limit or exclude our liability for death or personal injury caused by our negligence (including that of our employees, agents, or sub-contractors); or for fraud or fraudulent misrepresentation.
11.4 Nothing in these terms and conditions seeks to limit or exclude consumers’ legal rights. For more details of consumers’ legal rights, please refer to your local Citizens Advice Bureau or Trading Standards Office.
12. Data Protection
12.1 All personal information that we may use will be collected, processed, and held in accordance with the provisions of the Data Protection Act 2018 and the EU Regulation 2016/679 General Data Protection Regulation (“GDPR”) and your rights under the GDPR.
12.2 For complete details of our collection, processing, storage, and retention of personal data including, but not limited to, the purpose(s) for which personal data is used, the legal basis or bases for using it, details of your rights and how to exercise them, and personal data sharing (where applicable), please refer to our Privacy Policy.
13. Other Important Terms
13.1 We may transfer (assign) our obligations and rights under these terms and conditions to a third party (this may happen, for example, if we sell our business). If this occurs, you will be informed by us in writing. Your rights under these Terms for Entrants will not be affected and our obligations under these terms will be transferred to the third party who will remain bound by them.
13.2 You may not transfer (assign) your obligations and rights under these terms and conditions without our express written permission.
13.3 If any of the provisions of these terms and conditions are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that / those provision(s) shall be deemed severed from the remainder of these terms and conditions. The remainder of these terms and conditions shall be valid and enforceable.
13.4 No failure or delay by us in exercising any of our rights under these terms and conditions means that we have waived that right, and no waiver by us of a breach of any provision of these terms and conditions means that we will waive any subsequent breach of the same or any other provision.
13.5 We may revise these terms and conditions from time to time in response to changes in relevant laws and other regulatory requirements.
14. Law and Jurisdiction
14.1 These Terms and Conditions, and the relationship between you and us (whether contractual or otherwise) shall be governed by and construed in accordance with the law of England & Wales.
14.2 If you are a consumer, you will benefit from any mandatory provisions of the law in your country of residence. Nothing in Sub-Clause 14.1 above takes away or reduces your rights as a consumer to rely on those provisions.
14.3 If you are a consumer, any dispute, controversy, proceedings or claim between you and us relating to these Terms and Conditions, or the relationship between you and us (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.
